CBDT: AI-Driven Verification of Turnover Suppression in F&B Sector

SDG 16: Peace, Justice and Strong Institutions | SDG 8: Decent Work and Economic Growth

Ministry of Finance MoF | Department of Revenue DoR | Central Board of Direct Taxes CBDT

On 9 March 2026, the Central Board of Direct Taxes (CBDT) announced the results of a nationwide verification exercise targeting tax evasion within the Food & Beverage (F&B) sector. Following an investigation into 1.77 lakh restaurants using AI-enabled analytical tools, the Department identified a prevalent pattern of turnover suppression through the deletion of bulk bills and unauthorised data modifications. A targeted survey conducted on 8 March 2026 across 46 cities revealed a preliminary suppression of sales amounting to approximately ₹408 Crores.

To facilitate a trust-based compliance environment, the Department has launched the SAKSHAM NUDGE campaign, serving as a driver for voluntary rectification. Identified taxpayers are encouraged to utilise the functional provision of Section 139(8A) of the Income Tax Act to file updated returns by 31 March 2026, ensuring that high-fidelity financial reporting matches actual transactional data.

Key Findings of the Verification Exercise

  • AI-Enabled Data Analytics: Utilizing advanced tools to compare transactional data from 1.77 lakh restaurants against declared turnovers in Income Tax Returns.

  • Identification of Evasion Patterns: Detecting systematic under-reporting of income through the exclusion of specific transactions and the deletion of recorded sales from financial accounts.

  • Nationwide Survey Scale: Executing a coordinated exercise on 8 March 2026 covering 62 restaurants across 22 States and 46 cities.

  • Quantified Revenue Leakage: Uncovering an estimated ₹408 Crores in suppressed sales during the preliminary investigation phase.

  • The SAKSHAM NUDGE Campaign: Operationalising a "nudge" framework via emails and messages to 63,000 identified restaurants to encourage voluntary compliance.

  • Statutory Rectification Window: Promoting the use of Section 139(8A) for filing updated returns as a foundation for taxpayers to correct reporting errors without litigation.

What is the "SAKSHAM NUDGE" Campaign? The SAKSHAM NUDGE campaign is a communication-led compliance initiative designed to prompt taxpayers to correct reporting discrepancies voluntarily. It operates on the mechanical theory of "behavioral nudging," where the Department uses data-backed evidence to advise taxpayers of identified mismatches before formal audits are initiated. By providing a clear path for rectification through Section 139(8A) of the Income Tax Act, the campaign acts as a primary driver for reducing tax litigation and improving the accuracy of the national tax base. Effective communication is a prerequisite for this trust-based approach, allowing the Department to bypass intrusive enforcement for those willing to update their returns by the 31 March deadline.

Policy Relevance: Enhancing Tax Transparency

  • Operationalising Advanced Analytics: The use of AI-enabled tools serves as a primary mechanic for the Income Tax Department to detect high-fidelity patterns of evasion that traditional manual audits might miss.

  • Internalising Trust-Based Governance: The SAKSHAM NUDGE campaign provides a functional framework for the Ministry of Finance to promote voluntary compliance over coercive enforcement measures.

  • Bypassing Reporting Discrepancies: Utilizing transactional data as a prerequisite for verification ensures that the declared turnover of the F&B sector aligns with actual consumer spending.

  • Link to Revenue Mobilisation: Strengthening the reporting of the services sector is a foundational step for the government to secure the necessary fiscal resources for national development projects.

Relevant Question for Policy Stakeholders: In what ways can the government utilise GST transactional data in conjunction with Income Tax AI tools to mechanically identify under-reporting across other high-cash sectors?
