Haryana Strengthens POCSO Justice Through Tiered Forensic DNA Protocol With 99% Positivity Rate

Haryana has established a scientifically tiered forensic examination protocol for Protection of Children from Sexual Offences (POCSO) Act, 2012 cases, achieving a 99% DNA positivity rate with negative reports below 1%, positioning the state as a national benchmark in forensic reliability. The protocol was outlined by Additional Chief Secretary (Home), Dr. Sumita Misra, in response to concerns over high negative DNA outcomes in similar cases reported in other states.
The Haryana model follows a three-tier evidence filtration approach. The first tier prioritises time-critical medical examination of victims to ensure accurate collection, forwarding, and documentation of forensic evidence. The second tier introduces preliminary biology and serology screening of all samples to confirm the presence of biological markers indicative of sexual assault. Only samples that test positive proceed to the third tier β advanced DNA profiling, positioning DNA testing as a confirmatory tool rather than a blanket screening mechanism.
This selective approach aligns with international forensic best practices, comparable to evidence-triage protocols used by leading laboratories such as the FBI Forensic Laboratory. According to the state, the model improves judicial confidence, reduces misleading forensic interpretations, optimises laboratory resources, and accelerates case resolution through faster report turnaround.
To support this framework, Haryana has invested βΉ18 crore in DNA and cyber forensic facilities during the current financial year, approved βΉ101 crore for modern forensic equipment, deployed 40 mobile forensic vans, and expanded manpower. A new DNA Division at the Regional Forensic Science Laboratory, Gurugram, is scheduled to become operational from 1 January 2026.
